Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, NABIM expressly disclaims all warranties, conditions and other terms of any kind, whether express or implied, including, but not limited to any implied term of merchantability, satisfactory quality, fitness for a particular purpose, and any term as to the provision of Services to a standard of reasonable care and skill or as to non-infringement of any intellectual property right.

Limitation of liability
To the fullest extent permitted by applicable laws, and except in respect of death or personal injury arising from NABIM’s negligence, NABIM hereby excludes liability for any claims, loss, demands or damages of any kind whatsoever with respect to the Service, and any information, content, advertisements or products provided or distributed through the Service including, without limitation, direct, indirect, incidental or consequential loss or damages, whether arising from loss of profits, loss of revenue, loss of data, loss of use or otherwise and whether or not the possibility of such loss has been notified to NABIM. The foregoing will apply whether such claims, loss or damages arise in tort, contract, negligence, under statute or otherwise. If you are a consumer your statutory rights, if any, are not affected.
Exclusions and Limitations
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations of sections 5 and 6 may not apply to you.
In particular, nothing in these Conditions shall affect the statutory rights of any consumer or exclude or restrict any liability for death or personal injury arising from the negligence or fraud of NABIM.
These Conditions (including the guides and rules referred to herein) constitute the entire agreement between you and NABIM and govern your use of the Service, superseding any prior agreements between you and NABIM. The Conditions and the relationship between you and NABIM shall be governed by the laws of England. You and NABIM agree to submit to the exclusive jurisdiction of the English courts. Any failure by NABIM to exercise or enforce any right or provision of the Conditions shall not constitute a waiver of such right or provision. If any provision of the Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Conditions remain in full force and effect.
